Wisconsin citizens were given the opportunity to cast their vote on an advisory referendum in November 2006 that asked, "Should the death penalty be enacted in the state of Wisconsin for cases involving a person who is convicted of first-degree intentional homicide, if the conviction is supported by DNA evidence?" The referendum passed with a 55-45% majority. Because it was an advisory referendum, the legislature was not required to act. As of today, there is no legislation in the state of Wisconsin allowing the death penalty.
